Information on the protection of personal data

Information on protection of contact form

The processing of personal data shall be carried out in accordance with Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of individuals with regard to the processing of personal data and on the free movement of such data and repealing Directive 95/46/EC (General Data Protection Regulation), Regulation 5/December 2018.

Pursuant to Article 13 of that Regulation, the following information is reported:

Purpose of processing

Reception, treatment and follow-up of consultations, complaints and suggestions on European funds, including those related to the violation of fundamental rights within the framework of European funds.

Legitimation or Legal Basis

The processing of personal data is carried out by this Directorate-General for compliance with a legal obligation applicable to the controller:

Art. 6.1. of the GDPR, point (e) “processing is necessary for the performance of a task carried out in the public interest or in the exercise of public powers conferred on the controller”, on the basis of Art. 3.1 (a) Law 40/2015 of 1 October on the Legal Regime of the Public Sector and Art. 73.1 and 9.1 of Regulation (EU) 2021/1060 of the European Parliament and of the Council of 24 June 2021.

Addressees of data

The data shall be communicated to the responsible unit designated by each fund, in accordance with its scope of competence. Some of these units belong to ministerial departments of the General Administration of the State other than the Ministry of Finance.

International transfers

There is no general provision for international data transfers.

Data retention

The personal data processed shall be kept for a maximum period of 2 months from the receipt of the consultation, complaint or suggestion. After that deadline, the personal data will be deleted.

Automated decisions

There are no automated decisions.

Rights of data subjects

Data subjects may exercise their rights of access, rectification, erasure, restriction and opposition to processing before the controller, where appropriate, withdraw their consent, as well as their right not to be subject to decisions based solely on the automatic processing of their data, by means of this form of exercise of rights. The list of controllers and the data processing carried out by each of them within the scope of this Ministry, excluding its subsidiaries, is available in the Register of Processing Activities (RAT).

In the event that the personal data protection rights referred to in the preceding paragraph are not properly addressed by the controller to whom they have been requested, data subjects may lodge a complaint with the Spanish Data Protection Agency. Prior to the submission of such a complaint, data subjects may contact the Data Protection Delegate in accordance with the provisions of art. 37.1 of the above-mentioned Organic Law through this pre-claim form.

Data subjects may also contact the Data Protection Delegate (DPD) with regard to all matters relating to the processing of their personal data and the exercise of their rights under the General Data Protection Regulation (GDPR) via the Mailbox DPDHacienda@hacienda.gob.es, without requiring identification for the provision of this information service. The personal data provided in the request for information emails shall be processed in order to address the issues raised, with the Sub-Directorate-General for the Coordination of Information, Data, Web Services and Transparency being responsible for the processing of such data in the exercise of the functions of Data Protection Delegate. It may exercise its data protection rights to the controller. Please refer to more information on the treatment.

Purpose of processing

Registration and processing of applications for registration of the said act

Legitimation or Legal Basis

The processing of personal data is carried out by this Directorate-General for compliance with a legal obligation applicable to the controller:

In the event that the event is not held in the Ministry of Finance, the body responsible for the control of access to the event or the company that contracts the event may be assigned to perform this function.

International transfers

There is no general provision for international data transfers.

Data retention

The data shall be kept for the time strictly necessary to comply with the purpose for which it was collected.

Automated decisions

There are no automated decisions.

Rights of data subjects
